We use a third party disabiilty case manager to handle our disabiity claims. Our plan requires that employees notify the DCM before the 8th day of their disability. We have a very generous salary continuation policy for employees away from work due to disability. I'm interested in knowing if other employers have timliness reporting requirements and, if so, what are the penalties, if any, for not making timely notification.

We have a 30-day notice "requirement", however this is the company's policy not the Plan. I put requirement in quotes because it's a requirement only in theory. Obviously if there is an unforseen circumstance, we would not be penalizing someone for giving us less than 30 days. And if they come to us after a disability has already commenced, the only ramification is that they aren't going to have money coming in for a period of time. We have never disciplined for getting claim forms in late when it's something in place to benefit the employee in the first place. I just make sure they know this at orientation and again when they file a claim that the sooner they complete the forms, the better.
