We are considering adding a post tax premuim option to our medical plan for 2010. The purpose would be to allow employees who missed qualifing events etc to enroll or change enrollments. I would be interested in any information on this subject.

One particular question is: if an employee missed adding a new baby to the plan within 30 days, can they drop the pre-tax plan and opt into the post tax plan?

Does anyone know any good resources for informaiton on post tax premuim medical plans.

You have to have a qualifying event and apply for the change within the allowed time to drop the pretax premiums. If they would be outside the window to add the child to the plan, they would be outside the window to drop the pretax coverage completely as well.

I wonder though, if you could add the child, and then leave the current premium pretax and do the additional premium after tax?

What happens if the employee already has Family coverage? There would be no change in premium only an additional beneficiary.

Who set the 30 day window ? It seems easier to change the window.

I believe HIPAA set the 30 day rule in their special enrollment rights for addition of a new child. Most if not all the employers, and insurers, use that as the rule rather than allow more time.
