Statute on a 4971(a) excise tax, 5330 statue question

As I understand it, the filing of the 5500 does not matter at all, so it seems that a 4971(a) excise tax has a fairly open statute, especially if the taxpayer did not report the incongruity causing the 4971(a) relevant situation.
