Must one file a 5500? Must one amend the plan for new laws?

No 5500 series form is required, PROIVIDED the DOL's alternate disclosure and notification requirements are satisfied in operation. Otherwise the SEP would require a full SPD and have to file 5500 series forms.
The plan must be amended as announced by IRS. Most SEPs dated after 2002 are current. See instructions on model forms; contact sponsor of prototype plan.
