Excerpt: In previous posts providing an overview when district court remands to plan administrators may be appealed, little could be said about the Second Circuit Court of Appeals position. The recent case, Giraldo v. Building Service 32B-J Pension Fund, while not providing a definitive position, nonetheless provides insight as to the Second Circuit's view on the issue.
