[Guidance Overview]
Massachusetts Creating Country's Largest Open Multiple Employer Plan
"The rumor is that only not-for-profits with 20 or fewer employees will be permitted to join the plan as adopting employers but this limitation is not contained in the text of the bill. The bill defines 'not-for-profit' as eligible non-governmental organizations incorporated under Code section 501(c). There is no requirement for commonality among the employers or that they are related in any way[.]" (The Pension Protection Act Blog)

ASPPA Seeks Modification of Massachusetts Bill Authorizing State-Run Retirement Plan for Non-Profits
"HB 3754, a bill authorizing the state treasurer to set up a 401(k) plan for Massachusetts not-for-profits with 20 or fewer employees, passed the Massachusetts Senate ... and will soon go to the Governor for signature. ASPPA and other organizations are encouraging the Governor's office to return the bill to the legislature with a request that the maximum number of employees be reduced, and that not-for-profits that already have a plan be excluded from the state-run arrangement." (American Society of Pension Professionals & Actuaries)

[Guidance Overview]
Purchaser Need Not Duplicate Shut-Down Benefits When Mirroring Seller's Pension Plans
"In Shaver v. Siemens Corporation, [the court] issued a precedent-setting opinion addressing the complex relationship between ERISA's anti-cutback rules and common corporate transactions. This decision is important for employers considering acquiring another employer's assets and workforce because it addressed the employee benefits issues related to the common practice of providing transition benefits under the seller's pension plan after the closing date of an asset purchase." (Littler)

D.C. Office of Tax and Revenue Notice Released on Withholding Rules for Retirement Plan Distributions
"The requirement to withhold District of Columbia personal income taxes from periodic and non lump-sum retirement plan or retirement account payments has been repealed[.]" (Wolters Kluwer Law & Business / CCH)

New York Governor's Pension Plan Rejected by New York Assembly Democrats
"Cuomo, a Democrat, has said his overhaul of the pension system will save local governments and the state $113 bil.lion over the next 30 years as it raises the retirement age to 65 from 62 for most new workers. The proposal has drawn the governor into a battle with the state's public-worker unions and Comptroller Thomas DiNapoli, a fellow Democrat and the sole trustee of the $140.3 bil.lion pension fund." (Bloomberg)

EBRI's 2012 Retirement Confidence Survey Says Job Insecurity, Debt Weigh on Retirement Confidence, Savings (PDF)
"Americans' confidence in their ability to retire comfortably is stagnant at historically low levels. Just 14 percent are very confident they will have enough money to live comfortably in retirement (statistically equivalent to the low of 13 percent measured in 2011 and 2009)." (Employee Benefit Research Institute)

Virginia Legislators Approve Far-Reaching State Pension Reforms
"The last act of the General Assembly before adjourning Saturday night will change the way most future state and local employees pay for their retirement, and shift part of the pension burden to every teacher and local employee in Virginia." (Richmond Times Dispatch)

2012 Pension Funding Contributions Expected to Rise 30% to 40%
"Despite the rise in the stock market at the start of 2012, most plan sponsors will be required to contribute significantly higher amounts to their plans during the year in comparison to 2011 because funding requirements for most plan sponsors are based on average interest rates and smoothed asset returns." (Society for Human Resource Management)

Resource Page for the North Carolina Public School Teachers' and Professional Educators' Investment Plan
"The information on this web page provides information about the 403(b) plan as it will be administered by the NC Department of State Treasurer." (NC Department of State Treasurer)

Benefits in General; Executive Compensation

[Opinion]
Another Hand in the Pockets of Federal Workers
"The latest attempt in a seemingly unending series of proposals to cut their pay or benefits is scheduled for a Senate vote Tuesday. And once again, the plan is to use their money for unrelated projects. In an amendment to the highway bill now being considered [the money saved by extending the federal pay freeze would] fund energy projects, an adoption tax credit, and tax deductions for college expenses and for state and local property taxes."
