PHILADELPHIA, January 11, 2011 - James K. Edler, Jr., 63, of Horsham, Pennsylvania, was sentenced today to 40 months in prison for charges arising from three separate indictments. Edler was President of McFaul & Lyons Group, LLC, medical supply management consultants, located in Horsham, PA when, in 2004 and 2005, he stole $105,555 from an employee pension benefit plan. Edler was also charged, in separate indictments, with bank fraud and wire fraud. In an attempt to obtain approximately $20,000 that was levied by the IRS, Edler faxed a fraudulent Form 668-D “Release of Levy” that he altered from Pennsylvania to the Roy L. Schneider Hospital located in St. Thomas, Virgin Islands in October of 2006. He pleaded guilty to all charges and was sentenced for all crimes today.
In addition to the prison term, Edler was ordered to pay resitution to the employees in the amount of $105,555 and to M&T Bank in the amount of $217,791.
The cases against Edler were investigated, separately, by the Department of Labor Employee Benefit Security Administration and the Department of Labor Inspector General Office of Labor Racketeering and Fraud Investigation; and the Internal Revenue Service. They were prosecuted by Assistant United States Attorney Terri A. Marinari and by Assistant United States Attorney Melanie Wilmoth.
