I know that Code Section 213(d) defines what is considered “medical care” for the purposes of the Section 125 plan. Section 213(d) provides that an item is medical care if it is “for the diagnosis, cure, mitigation, treatment, or prevention of disease or for the purpose of affecting any structure of function of the body….” I do not believe that it is because it was not prescribed by a physician. It would seem to me that if they eliminated the prescription requirement for allergy medicine, that the same thing would apply here. So, did Mrs. Cheney really buy one of these things and Mr. Cheney is looking for reimbursement? I hadn't realized the White House sponsored an FSA for UME.
