Does anyone know of perhaps a Latin term to describe where a situation stands as silent on certain parameters and one must insist on explicit statement in contrast to just presuming the silence as sufficient?

For example, if a plan document referred to "payment" without stating by whom (whether only by the employer(s) hosting the plan or by any and all, each and every member of the controlled group stands as ambiguous and lacking disambiguation), what phrase, perhaps a Latin phrase, provides for the requirement for explicit statement?
