Indeed they did! ARA GAC was one of the stakeholders pushing this after LTPT in S 1.0, so I count this as a big win for our advocacy folks. Its not always instant results, but this is big one. We have plenty of plans that will drop out of audit because of it.

Practitioners and industry organizations are really the ones who have pushed e-filing of the 5558 (for good reason). IRS has had a "we will get to it when we have time and funding" approach...

ASAP. The EBSA manually reviews all filings with attachments for confidential information within a few days of the filing.

Regulation by a memo that has no force of law. A perfect example of how the entire regulatory structure (401a, 403b, etc) is BROKEN and should be replaced from the ground up (ie, it could be substantially simpler).

An incomplete return can be considered not filed...I would check amended and file also...if you met the deadline clearly no problem...

Good... Not sure what e-sign service is in use, but when we add a participating employer, we do an "addendum" (not a restatement) and it requires two signatures - and our e-sign process specifies in advance who needs to sign, and routes the document as specified, automatically. If the same person needs to sign as both, we set it up with signatures in two places, and it can't be complete until both signatures are completed. If it isn't completed with a period of time, reminders go out, and it's set up with an expiration date - and well before the expiration date, someone is reaching out to find out why the document wasn't complete. Pretty straightforward - and the only problem we had was finishing up cycle 3 restatements (we did about 2200 of 'em) was ONE client who couldn't sign, because he couldn't get internet service or phone service on his skiing trip to the Swiss Alps, and there wan no other authorized signer.... Poor guy..... 😁
