  1. I have a QDRO that was signed by the Court and i am sending now to Plan administrator a Certified copy. However, I have an ex-spouse who is surrounded with sketchy, dangerous people who are unset that I am awarded this portion of his retirement. Is there anyway I can request that the plans not communicate with them once the QDRO is approved and the benefits are segregated for safety reasons?
  2. Does a Judgement of Absolute Divorce in Maryland outlining Retirement through a QDRO and Alimony ever expire, or is it a Duty once it is ordered in a JAD and never expire?

  9. Dear Mr. Goldberg, Thank you so much for responding to my message. I am trying to file a Pension order that was prepared by an Attoney, but who is not responsible for submitting the orders to the Court. I have served my ex-spouse with the Order, but I have not heard back in over 3 months. How should I go about filing these orders with the Court in Prince Georges County Circuit Court?   10. Can someone explain and simplify what this means for me in a QDRO? Can someone map out what the mathematic equations would look like: The Marital Share: This Order assigns to the Alternate Payee as a shared interest in an amount equal to fifty percent (50%) of the martial share of the Participant’s Accrued Benefit under the Plan. The martial share to the former spouse shall be computed by multiplying the monthly annuity of the Defendant by 50% and by multiplying the product thus derived by a fraction. The fraction shall have a numerator and shall include all months of the parties’ marriage from August 23, 1982, through November 11, 2009, and the denominator shall be the total number of months that the Participant accrued benefits under the Plan in order to first become eligible for Retirement Benefits under the Plan.
  11. In Maryland what happens if an ex-spouse refuses to sign a QDRO from 14 year old Divorce. Can the courts just sign it and do you recommend keeping the Signature line on the QDRO if it is not signed?

  13. My Divorce Decree says that my ex-wife is entilited to "any benefits under my pension plan" Does that also mean she is entilited to health care when I retire or a payment I am required to make to pay for part of her health care?

I have my suspicions that my ex-spouse withdrew some of the funds from that account ... and I just would like to know what are some kinds of circumstances/reasons that allows someone to withdrew from a 457 Plan account?
