I have a QDRO that was signed by the Court and i am sending now to Plan administrator a Certified copy. However, I have an ex-spouse who is surrounded with sketchy, dangerous people who are unset that I am awarded this portion of his retirement. Is there anyway I can request that the plans not communicate with them once the QDRO is approved and the benefits are segregated for safety reasons?

Does a Judgement of Absolute Divorce in Maryland outlining Retirement through a QDRO and Alimony ever expire, or is it a Duty once it is ordered in a JAD and never expire?

I was reviewing the Department of Labor Handbook and I see that a QDRO can contain more than one retirement plan. Would you recommend including two retirement plans into one QDRO -- Pension and 401k if it is the same employer?

You can tell a Defined Contribution Plan to pay a Lump Sum payment without reference to Alimony? Am I correct?

If the Participant has not yet retired as of the date of the filing, wouldn't you need to include the Months of marriage and direct the Plan Administrator to divide the months of marriage with the months of employments?

I'm a bit confused, I thought providing the dates of marriage would allow the plan to calculate the Marital Pension to be divided? Am I incorrect?

I am trying to file a Pension order that was prepared by an Attoney, but who is not responsible for submitting the orders to the Court. Can someone explain and simplify what this means for me in a QDRO? Can someone map out what the mathematic equations would look like: The Marital Share: This Order assigns to the Alternate Payee as a shared interest in an amount equal to fifty percent (50%) of the martial share of the Participant’s Accrued Benefit under the Plan. The martial share to the former spouse shall be computed by multiplying the monthly annuity of the Defendant by 50% and by multiplying the product thus derived by a fraction. The fraction shall have a numerator and shall include all months of the parties’ marriage from August 23, 1982, through November 11, 2009, and the denominator shall be the total number of months that the Participant accrued benefits under the Plan in order to first become eligible for Retirement Benefits under the Plan.

In Maryland what happens if an ex-spouse refuses to sign a QDRO from 14 year old Divorce. Can the courts just sign it and do you recommend keeping the Signature line on the QDRO if it is not signed?

Does anyone have experience drafting Pension Order for Washington Metro Area Transit Authority Plans (WMATA)?

My Divorce Decree says that my ex-wife is entilited to "any benefits under my pension plan" Does that also mean she is entilited to health care when I retire or a payment I am required to make to pay for part of her health care?

What does the Divorce Decree mean, It's Reads: the Plaintiff shall be entitled to her marital share in any benefits under Defendant's pension plan, or payments made in said pension plan, through his place of employment if, as and when Defendant's entitled to receive any such benefits, and Plaintiff's interest in said plan benefit shall be calculated as of the date the benefits are to be paid under said plan using the the Bangs Formula? I should have addressed this with the court, but what does this mean for my ex-wife's portion of my benefits?

If everything was acquired during marriage in Maryland, does the have to divide any Retirement Plan/Assets that were acquired and purchased during the ask. I ask because my 401k was initated during our marriage, but my court order does explicitly mention the 401k. Is it possible for my ex-wife to go back to court and say that this was an error on the court part because it was Marital Money?

Thank you so much sir. I really do appreciate all of your great help! My ex-wife did not remarry and I did a rough calculation that she will receive $1218 out my $6187 pension. The question is about survivor benefits. I met with a lawyer today who said if that the QDRO would likely result in survivor benefits because the JAD says she is entitled to "any benefits under my pension plan" which included Survivor Benefits, among other things.

The JAD reads "Plaintiff (ex-wife) is entitled to her marital share in any benefits under Defendant's Pension Plan." Very confusing language, but that is what it reads and I'm just interested in some clarification.

The marital share of the Pension was split in the half and it that my ex-wife was entilited to "Any benefits under Pension Plan."

What are some exceptions that allow you to remove funds from your 457 Plan and can you remove your entire balance? I'm with Lincoln btw.

My ex-wife was awarded a portion of my Pension and 401k Balance over 20 years ago when were divorced. The QDROs were never filed, but I am just receiving a notice in the mail regarding a hold on my 401k account as a result of ex-wife submitting a draft DRO. My ex-wife was also entitled to "any benefits under Pension plan." Does that mean Survivorship and is it too late for her to filing these QDROs 20 years later?
