  2. This happened to me, he tried to waiver my rights, without me knowing. Plan admin hid it . And didn't follow dro. I never signed waiver. Took them to court. They lost.

  4. He did. The judge didn't fine them or give lawyer fees. The verdict is done. But my lawyer working on numbers now. When this is over can I take to a magistrate or back to court for legal fees? Any domestic case can ask for lawyer fees to be paid in pa.

  6. I won my case against pension plan. They breached qdro and my rights. Paying all back payments with interest and re instating my monthly benefits. That's great, but, can I file to get all my lawyer fees back ? This was a domestic relations civil case. And I should have never been in court if they would have not lied and cheated me. I am in P A. Are there cases texts or laws I can look at?
  7. Thank you,. So much,. So if the plan accepted it, which is now quadro, then that's what the plan must follow,. Not him trying to change it after quadro was already accepted. That's what I thought.
  8. Which over rules and why? 1. Quadro order stating alt. Payee, which I'd former spouse gets 50 percent. Was signed in 2000. 2. Ex in 2005 assigned no survivor benefits when he took retirement. If quadro was legal and in place, in 2000, then ex can't waiver to no benefits in 2005, with order already in place. Legal to do?? Plan manager over looked quadro. And let ex waiver. Legal? Note in quadro, any changes to quadro must be reported to judge. Plan never reported, Spouse found out, he changed plan benefit after he died, legal?

  10. Ex is partic. I am alt payee to get 50 percent of pension. It's all detailed that I get half.. no question there. The question is. By him signing he didn't want death benefits,. He did on purpose,.... When he and plan knew there was a quadro. Question.??? Does the quadro overrule that paper he signed. Just opinions please...
  11. Divorced,. Both signed qualified Domestic order, accepted by plan and judge. All in order. In 2010. Now, in 2016, ex filed for retirement, and instead of choosing. j&s,. He choose , no death benefits,. Even though he and plan manager knew, about quadro. Question. Does plan have to follow quadro already in place? Or, follow what ex signed after quadro. Does ex over ride judge's order. I think not. And plan manager should follow judge order.
