k man Posted June 25, 2001 Posted June 25, 2001 Can a Rabbi Trust be assigned to another employer (a subsidiary of the original plan sponsor/grantor)? Would this situation be any diffenrent then the assignment of a qualified plan trust?
Guest hank Posted June 25, 2001 Posted June 25, 2001 k man - I think so (depending on the language of the trust instrument). Not too long ago, we titled our rabbi trust assets in the name of a Delaware sub to reduce state capital stock taxes. It wasn't a full blown assignment (just changing the title to the trust assets), but it had the same effect. You may also want to examine IRS Notice 2000-56 (last fall) dealing with parent/sub relationships and rabbi trusts.
