Guest RBeck Posted July 30, 2001 Posted July 30, 2001 what's your take on this situation: A firm uses a POA to sign Form 5500 for the Plan Administrator, then the person named on the POA has his secretary sign his name to the forms.

I would have to believe that if "X" is named on the POA, and that "Y" (the assistant to "X") signs the form, then it is not valid. I suppose if "Y" has POA for "X", you might have half a leg to stand on, but I wouldn't count on it.
