Guest Ben S Posted January 28, 2002 Posted January 28, 2002 Client wandted to merge MP into 401k on 12/31. All resolutions and notices were sent 12/27 and lost in mail. This assumed a freezing of the mp cont effective 1/20 in the 204h notice (safe enough to avoid accruing anything in 2002. Now that this whole package was lost, what recourse do we have? Can resolutions and amendments be signed currently, but retro? Obviously, this notice has to be redated probably out to Feb 20 to give enough time for notise of frozen MP. Thoughts??
Archimage Posted January 28, 2002 Posted January 28, 2002 You can still merge the plans but you cannot do it retroactively since the 204(h) notice did not go out. You will have to restate both plan docs for GUST and do a final 5500 for the 2002 plan year.
Guest Ben S Posted January 28, 2002 Posted January 28, 2002 Thanks, thats the assumption Im going on. Just wanted to see if anyone knows anything tricky that Im missing. The plan does have an hours requirement so I believe Im safe from accruals.
