Guest bosco Posted November 27, 2002 Posted November 27, 2002 Is there any restrictions/regulations that keep union employees from participating in a 125 plan?
GBurns Posted November 28, 2002 Posted November 28, 2002 Union members are usually employees who join a union ratified by their employer. Union employees work for a union. Which do you mean? In any case there are no restrictions that stop employees (unionized or not) from participating in a 125 plan set up by their employer, unless there is a collective bargaining agreement or other agreement that prohibits this. mbozek Posted November 28, 2002 Posted November 28, 2002 Union members usually work for an employer and the union represents the union members in negotiating for benefits and other terms and conditions of employment. While union members can participate in a cafeteria plan the same as other employees, an employer cannot offer any benefits program such as a 125 plan to union members without negotiating first with the union that represents them. Private employers who have union employees are subject to the NLRB rules regarding negotiation of benefits for union members. mjb
