Eligibility Question

Employee works part-time, is over age 65.

Employer sponsors cafeteria plan. Cafeteria plan requires 30 hours per week for eligibility. This employee works more than 30 hours per week.

Any reason why this employee cannot participate in the cafeteria plan? Any Medicare implications?

I know nothing about Section 125 plan rules so ANY insight is helpful to me.

No problems. Regardless of his age, if he is an active employee and meets all plan rules (both the 125 plan and any underlying health plan he may sign up for), he can be treated as if he were 35.

Make sure that he informs Medicare of this other coverage and fills out the proper Medicare form, if not he will pay a severe penalty later on when he does go on Medicare.
