Sect. 125 and State Sponsored Health Plans

Can an employee change elections made during open enrollment because their children have become eligible for our state sponsored health plan?

I remember reading that this is not allowable because it would violate something in the Social Security Act???

Any insight?

1.125-4 says that losing coverage under state-sponsored coverage is a status change, but gaining eligibility is not. No change is allowed.

I must be too tired, but I could not find a reference to any state sponsored coverage (other than Medicaid) in 1.125-4, can you give a full cite?
