Guest hcadi Posted January 21, 2003 Posted January 21, 2003 Can an employee change elections made during open enrollment because their children have become eligible for our state sponsored health plan? I remember reading that this is not allowable because it would violate something in the Social Security Act??? Any insight?
papogi Posted January 21, 2003 Posted January 21, 2003 1.125-4 says that losing coverage under state-sponsored coverage is a status change, but gaining eligibility is not. No change is allowed.
GBurns Posted January 22, 2003 Posted January 22, 2003 I must be too tired, but I could not find a reference to any state sponsored coverage (other than Medicaid) in 1.125-4, can you give a full cite?
