dmb Posted April 3, 2003 Posted April 3, 2003 Can a C-Corp with two 50% owners and no other employees file a Form 5500-EZ?? Pursuant to instructions of line 7b, I'm having doubts. Thanks.
david rigby Posted April 3, 2003 Posted April 3, 2003 "Who May File" is on page 1 of the instructions. http://www.dol.gov/ebsa/pdf/2002-5500-ez-inst.pdf I'm a retirement actuary. dmb Posted April 4, 2003 Author Posted April 4, 2003 so would you say that two 50% owners of a corp does not fit the "partners of a business partnership" criteria??
Belgarath Posted April 4, 2003 Posted April 4, 2003 Right. They aren't eligible for EZ filing, unless they are spouses.
Blinky the 3-eyed Fish Posted April 4, 2003 Posted April 4, 2003 I would recommend they marry each other for ease of filing reasons. Perhaps after time they will grow to love each other. "What's in the big salad?" "Big lettuce, big carrots, tomatoes like volleyballs."
dmb Posted April 7, 2003 Author Posted April 7, 2003 Maybe if they were from California, that might work, otherwise i don't think it's going to happen. (Just kidding)
Guest Stacy Posted April 16, 2003 Posted April 16, 2003 It is my understanding that you may file the EZ. The instructions say yes if certain criteria are met. One of those criteria are "the plan covers one or more partners"
Mike Preston Posted April 16, 2003 Posted April 16, 2003 Stacy, the original poster indicated that the entity in question was a C-Corp, not a partnership. Hence, the participants in this case are not "partners".
