Archimage Posted June 27, 2003 Posted June 27, 2003 I have a multiplemployer plan sponsored by a PEO. The PEO handles most of the employee benefits for all participating companies. Some of the sponsoring companies have the cafeteria deductions come straight to them and other have the cafeteria deductions go straight to the insurance companies. Is it okay to file one form 5500 for this plan or does this issue cause multiple 5500s to be filed?

Like, is this arrangement a MEWA? Your topic is "cafeteria", which has no filing requirement, so I assume we are talking about the welfare plan requirement. I'm guessing you have more than 100 participants. However, if we take the question at face value, only one 5500 would be filed for a multiple employer plan. The fact that it is funded hrough a cafeteia plan, or that some funds go to employes, and some go to insurance co., should not affect the filing requirement. John Cheek CPA www.cpaSPAN.com

It seems that not all clients participate and that the participating clients have a number of different insurance plans from a number of different insurers. Also a client seems to be able to "have" some items with the PEO and some items outside the PEO. Is this correct? Also are you asking about the filing requirement for the PEO or the filing requirement for the clients? George D. That is what I figured but needed some reassurance since I do not deal with cafeteria plans often. GBurns, you are correct that they do have options to do different services with this PEO. However, they all do use the cafeteria plan. I am asking the filing requirement for the multiple employer plan.
