Employee's child has been diagnosed with a mild learning disorder.

The doctor has recommeded a tutor to help the child out the disorder. Would this expense be reimbursable under the medical reimbursement account? I can't seem to find information anywhere. any help would be appreciated.

Can you analagize the tutor's services to a form of therapy; i.e. speech, or physical, or hearing? Therapy can be considered medical treatment and accordingly be reimbursed.

Revenue Ruling 78-340 provides that amounts paid for tutoring of a child with learning disabilities caused by a neurological disorder are deductible if the child's doctor recommended the tutoring. In the ruling, the tutor is specially trained and qualified to deal with severe learning disabilities. The IRS Publication on Medical Expenses also suggests that tutoring expenses may be deductible if such tutoring is recommended by the child's doctor or other medical professional for treatment of a medical condition. This presupposes that your medical FSA looks to the standards for deductibility of medical expenses under Section 213 of the Internal Revenue Code to determine which expenses may be reimbursed under the FSA.
