Are we required to have every employee sign a Cafeteria Plan Enrollment Agreement on an annual basis. Or, is it sufficient to have an agreement signed upon enrollment and leave it open ended?

Commonly known as an evergreen election, plan should have provisions that permit such elections. Also plan should provide mechanism permitting participant to change annually should they wish.

We have it set up that if we do not receive the forms by a certain date, than the benefits will remain the same the following year (except for vacation days)
