Guest Karin Posted December 9, 2003 Posted December 9, 2003 I have a participant who has a whirlpool spa at home that is used to treat a specific medical condition. He wants to submit the chemicals & supplies he uses for the upkeep of the spa. If this an eligible expense to put through a FSA? Does anyone know where I can find this in the regs.
Guest JerseyGirl Posted December 9, 2003 Posted December 9, 2003 I don't think you will find anything in the regs, but we had a similar situation not long ago. After considerable research, we allowed the purchase of a portable spa as an eligible expense, BUT, with some restrictions. We found out the number of members of the family living in the home (which was 2) and therefore would only allow 50% of the cost -- knowing full well that although the wife was using the spa for therapy -- and provided the documentation from her doctor and physical therapist to prove it-- her husband was very likely to get in there and simply enjoy. Since the care and upkeep of a seeing eye dog, or contact lens for that matter, are considered eligible expenses, I would allow it, but with the same restrictions as stated above.
Guest JTrini8302 Posted December 9, 2003 Posted December 9, 2003 I've seen this before as well. Like JerseyGirl, we paid for x% based on the number of people in the household and required documentation from the treating physician.
