Guest CCarter Posted December 30, 2003 Posted December 30, 2003 Is the SAR form still required with the final (last) filing of the 5500?
MGB Posted December 30, 2003 Posted December 30, 2003 Yes. There is a DOL Opinion Letter from 1978(?) that says yes.
Guest lsh Posted January 9, 2004 Posted January 9, 2004 Yes, I agree Sec 2520.104b-10 Summary Annual Report - (a) Obligation to furnish. ......The plan administrator of any employee benefit plan shall furnish annually to each participant of such plan and to each beneficiary receiving benefits under such plan (other than beneficiaries under a welfare plan) a summary annual report conforming to the requirements of this section..... Even in the year a plan terminates eligible employees are 'participants' in the plan. Not that many employees ever read their SAR ... but it would give information showing that the plan did terminate, assets going to zero, income statement showing totally distributed or transfers out of the plan.
