Rai401k Posted March 31, 2004 Posted March 31, 2004 Our Plan Document defines Dependant as "within the purview of Code Section 152". My question is it permissible for a medical reimbursement plan to allow reimbursement of medical expenses for children that do not meet the support test.
Guest b2kates Posted March 31, 2004 Posted March 31, 2004 I think not, The rules for medical reimbursement are that the reimbursement must be tax free. If a child is not the dependent under the 152 test, then the payment would not qualify as tax free.
