katieinny Posted April 21, 2004 Posted April 21, 2004 The VEBA is administered by a teacher's association at a public school. It's a funding vehicle for paying participants' out-of-pocket medical expenses. I understand that they are required to file a Form 990, but is a 5500 also required?
katieinny Posted April 22, 2004 Author Posted April 22, 2004 What I really need to know is this -- because the plan is for public school teachers, does that make it a government plan and therefore exempt from filing a 5500?
Guest b2kates Posted April 22, 2004 Posted April 22, 2004 Who is the Plan Sponsor to determine if it is a governmental plan.
katieinny Posted April 22, 2004 Author Posted April 22, 2004 The plan is titled the XYZ Teachers' Association Medical Expense Reimbursement Plan and was signed by a ranking member of the teachers' association. The public school district makes the contributions.
Guest b2kates Posted April 22, 2004 Posted April 22, 2004 without any research, it appears to be a "union" sponsored plan, not a governmental plan. If it covers more than 100 participants it would need to file a 5500. confirm that it is filed with the IRS and recognized as tax exempt; thereby filing a form 990. If not tax exempt as a trust it would file a 1041. Remember since there is a trust an audit must go along with the 5500.
