5500 for health insurance plans not part of a cafeteria plan

Does a health insurance welfare plan with over 100 participants at the BOY need to file a 5500 Form IF the insurance plan is specifically not part of the cafeteria plan? (These are insured plans with the premiums paid from the general assets of the Employer.)

Yes, I believe a 5500 is required, filing the Schedule A, and whether the plan is part of a 125 has no bearing on that. It would be required either way.

It sounds to me like you know have 2 plan filing requirements. One for the Health plan and one for the Cafeteria plan (assuming that the cafeteria plan has a medical reimbursement spending account).

Could be a good candidate for a WRAP document.

We did prepare a wrap document when we they instituted a 125 plan. We discovered that while they had health insurance plans before, the participants were paying on a post-tax basis, and no 5500 had ever been filed for these health plans. We're wondering if we should file 5500's for before they had a 125 plan.

All welfare plans that have 100 or more participants as the Beginning of the Plan Year are required to file form 5500.
