Guest carmjoe Posted July 28, 2004 Posted July 28, 2004 Can someone confirm that an employer with union employees covered under a union-sponsored health plan doesn't have to file a 5500 for that plan? I assume it would be the responsibility of the Union since they are the plan administrator. Is this correct?

Lori Friedman Posted July 30, 2004 Posted July 30, 2004 You're describing a multiemployer plan that is maintained pursuant to collective bargaining agreements. Under DOL Reg. Sec. 2510.3-37, just one Form 5500 is filed for each multiemployer plan, and the contracting employers do not file individually. The employers don't sponsor a multiemployer plan; instead, the plan is sponsored by its own Board of Trustees. Lori Friedman
