Guest LAnderson Posted December 9, 2004 Posted December 9, 2004 Hi - kind of an obscure question... Under Sarbanes-Oxley, accounting firms that perform client audits cannot also do tasks that would be "acting as management" for the client. Does the preparation of a Summary Annual Report fall into this category? I think that prep of the SAR is a direct function of the prep of the 5500, which is tax work, so I'm inclined to say there is no conflict. However, when we prep an SAR, we're drafting, reviewing and editing a document that the company will put on their letterhead and send out to plan participants. Has anyone heard of this being a SOA conflict?
WDIK Posted December 15, 2004 Posted December 15, 2004 we're drafting, reviewing and editing a document that the company will put on their letterhead and send out to plan participants Are you sure that the SAR needs to be put on company letterhead? I dont' think that this is a typical practice and in my opinion seems to be the only possible link you list to "acting as management." ...but then again, What Do I Know?
