Guest rocnrols2 Posted March 10, 2005 Posted March 10, 2005 USERRA requires the employer to offer COBRA-like continuation rights to employees going into military service for medical coverage for up to 24 months. Any thoughts on whether this applies to a medical flexible spending account?
oriecat Posted March 11, 2005 Posted March 11, 2005 I believe so. It's still a form of a group health plan.
Guest FAQ Posted March 28, 2005 Posted March 28, 2005 Since COBRA coverage for an FSA only extends to the end of the year in which the participant terminated, shouldn't the 24-month rule be inapplicable? See Reg. §54.4980B-2 Q/A-8 (d).
