Guest 401KTPA Posted August 2, 2005 Posted August 2, 2005 We filed the extension form 5558 for a client for their profit sharing plan for plan year ending 12/31/04 in time but they just called to tell me that their other vendor did not file the 401k extension in time. Does anyone know if they can still send the form in and are there any penalities if they send it in late. thanks
Belgarath Posted August 2, 2005 Posted August 2, 2005 It's now too late to file a 5558 for a calendar year 2004 plan year. Assuming plan and fiscal years are the same, do they have a tax extension for 2004? If not, then I think all they can do is hop to it and get the 5500 forms filed promptly under the DFVC program.
david rigby Posted August 2, 2005 Posted August 2, 2005 Do these plans cover the same employees? If so, why not merge them and have only one 5500 to worry about? I'm a retirement actuary. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
