Guest Kristine Posted April 6, 2006 Posted April 6, 2006 The person who was doing the Plan Documents and Summary Plan Descriptions before me messed up royaly and the dates to submit claims for reimbursement do not match between the two documents. We are debating on whether or not to write a new Plan Document and submit it to the client to sign and back date to 12/31/05. Has anyone run across this, or what do you all think of this?? We need help right away!!! Thank you!
Guest Green92 Posted April 6, 2006 Posted April 6, 2006 Doesn't the SPD have language that says and discrepencies shall be decided by the plan document?
Kirk Maldonado Posted April 6, 2006 Posted April 6, 2006 There was a TPA in San Diego that reportedly went to jail for backdating documents. If you want to do that you should retain competent ERISA counsel to advise you and possibly a criminal defense attorney. My guess is that they will tell you not to do that. Posting a message in a public forum that you are considering backdating documents probably isn't the wisest thing to do. Kirk Maldonado
