mal Posted April 18, 2006 Posted April 18, 2006 Most states no longer recognize common law marriages, therefore my guess would be no; unless of course the person can prove the existence of a valid law marriage in their state of residence. We have seen this come up a couple of times with regard to death benefits under a pension plan...kids versus common law spouse.
