The company I work for is looking at administrating flex for a large corporation that has mulitple office through out the United States. I am wondering if we need a TPA license in any of these states to be able to administer flex. I am not sure where to find the answer to this question. Any help would be appreciated. I am mainly concerned with NY, IL, CA.

The answer depends on the insurance laws of each state. Only about 15 states even license TPA firms. The ECFC has a nice library with such information. If you are going to be doing a significant amount of flex administration, you may wish to join. ECFC However, you could contact each of the 3 insurance departments for less than the cost of a membership.

However, I understand that it is a very expensive organization for an employer to join. Are the membership costs for TPAs more reasonable?

I believe they have a reduced fee based on the size of the member organization. One reason for the high fees is b/c they are a lobbying organization. However, they recognize that TPAs will join if resources and educational materials are provided. You might also look to see whether EBIA has any material on this.

You would have to check with each state in which you intend to operate. Also, some states require TPA's to be bonded. You might want to check that out also.

When checking into this, might want to also check "registered" rather than "licensed". I believe North Carolina requires a registration of TPAs doing flex work, but a actual license is not required.

Can you tell me where on the ECFC site this is? We belong and I cannot find this information (although I have a hard time finding anything on the ECFC site). Thanks
