Although I've researched significantly, both on line, and "hard copy" materials, including government filing instructions, I've yet to see addressed reporting requirements RE (amended?) SAR: - is amended SAR required? (logically, it would seem so); - if so, form of reporting requirement?; - if so, timing of handout to participant? Appreciate review and feedback. Geo
Locust Posted August 3, 2006 Posted August 3, 2006 I'd revise the SAR and distriubte it following the amended 5500 filing - maybe with a brief note: "here is an amended SAR for 2004." The old SAR is wrong - can you consider it to be distributed if it is wrong? I don't think so.

Guest Ira Hayes Posted August 11, 2006 Posted August 11, 2006 An incomplete and/or erroneous Form 5500 is subject to DOL penalties not to exceed $1,100 per day late. Hence, it is not outside the realm of possiblity for DOL to assess $100 daily penalties per participant (who requests a copy of a SAR) when an incomplete and/or erroneous SAR has been distributed.
