My husband is under one classification and I am under another. My job has approved a HDHP with an HSA in which my employer is going to fund $3500 into the HSA the first year. I wanted to put me and one child on this and keep my husband and the other 3 children on his plan. My employer is now saying we can't both have coverage because it is double dipping, but that sounds like denying coverage to me.
leevena Posted November 28, 2006 Posted November 28, 2006 Probably not, but you need to check because each state is different and I do not know each state's laws. The term "double-dipping" sounds like an excuse being used because the costs may now be higher than anticipated. Usually a single family unit is a lower cost than what you are wanting to do now. I would check with the employer and ask for some type of written HR policy/documentation that forbids this, they may have one on file.
Mary C Posted November 29, 2006 Posted November 29, 2006 Our plan specifically states that if both husband and wife work for us, each member of the family may only be covered once. We do allow husband to elect one plan option and wife to elect another plan option, but do not allow them to cover each other as dependents if they do this. Children may only be covered under once, also. Check the plan document or SPD. You should also make it clear to the employer that you are electing to cover each individual only once, but under different options.
