Everett Moreland Posted March 6, 2007 Posted March 6, 2007 A recent IRS statement by Plan Sponsor: Final rules under tax code Section 409A should be out fairly shortly, and they will be "voluminous," Cheryl E. Press, senior counsel at the Internal Revenue Service's Office of Division Counsel/Associate Chief Counsel (Tax-Exempt and Government Entities), said last week, according to a report by Washington-based publisher BNA. The guidance is expected by June 30 and will address what constitutes a substantial risk of forfeiture, she said, according to the report.

namealreadyinuse Posted March 7, 2007 Posted March 7, 2007 Treasury is on record as saying they are now waiting on release of the 415 regs, so nothing will happen until then.

Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.

They are not effective until April 17, 2007.
