Can I use Form 5558 rev August 2004 even though they have a new form now (rev January 2007)?

Why would you want to?

I don't have an answer for you, because I haven't heard of anyone doing it, and if they did, I haven't heard whether or not the IRS refused to accept it. But I would recommend removing the uncertainty and simply using the updated form.
