Guest Sheb Posted October 29, 2007 Posted October 29, 2007 A not for profit company is all HCE's and wants to establish a Flexible Spending Account program. I know that the HCEs and Key employees have to pass tests so the plan does not discriminate. But can the plan consist of all HCEs?
