Guest mab Posted November 20, 2008 Posted November 20, 2008 I have an employee who asked whether he could submit for reimbursement his payment of his daughter's health insurance premiums. She is not on his family policy but she is regarded as a dependent under the code and for income tax reporting purposes. Any help would be appreciated. Tx.
Guest Benefit Specialist Posted November 20, 2008 Posted November 20, 2008 No health insurance premiums are not eligible under an FSA.
Jacmo Posted November 20, 2008 Posted November 20, 2008 So amend the 125 plan to allow premium reimbursement, although that may open a huge can of worms regarding other laws. EBIA recommends against it.
J Simmons Posted November 20, 2008 Posted November 20, 2008 125 reimbursement of individual health insurance premiums is like threading a needle when avoiding those other laws that Jacmo speaks of. QDROphile Posted November 20, 2008 Posted November 20, 2008 You may be able to thread the needle, but you can still get pricked by the point.
