Just heard from the grapevine that the 5500-EZ wont be ready until late Summer. Is this true? If so, I wonder when the due date will be.

Also, a friend of mine told me that the 5500 and the 5500-SF have not officially been released. Yet FT William says that they have been submitting forms to the DOL. Anyone got a clue??

You can log on to the DOL web site (efast) and see both the 5500 and 5500-SF forms which have to be filed electronically. You file the 5500-SF in lieu of the 5500 EZ

It is my understanding that although a one participant plan may file 5500-SF rather than the 5500-EZ, it is not required. In fact, some are of the opinion that it is better to file the EZ because the SF is subject to public disclosure while the EZ is not.

I agree that the EZ is the better choice to file as its not public info. But the questions are

1. Has anyone else heard that the EZ might be released late summer?

2. According to DOL, companies that are EFAST2 approved will be able to file the form electronically AS SOON AS the final form is released. Has the Form 5500 and/or the Form 5500-SF been offically released?

5500 and SF were officially released some time ago and 2009 forms are being processed. We have not done any.

Question - has the "rumor mill" also opined as to whether the EZ will be reformed to allow ALL "one participant" plans to file the EZ? If not, then some of them will be forced into filing the SF, whether they want to or not. For example, plan is a controlled group/affiliated service group.

ASPPA released ASAP 10-03 yesterday, which says the 2009 5500-EZ has not been released yet and that ..."we expect the release of the form may not come until this summer."

What about a plan that terminated in 2009 and the assets were distributed 12/7/2009?

We didn't worry about filing before 12/31/2009 to avoid having to file electronically because it's an EZ.

We don't want to file a SF - can we file now using the 2008 EZ since the short plan year ended 12/7/2009?

Or must we wait until this summer to file a 2009 EZ?

The forms are up on the DOL web site and I have done 3 directly and they have been processed successfully.
