Guest nlipton Posted February 24, 2010 Posted February 24, 2010 Does anyone have any citation to statute, regulation, or case law concerning the right of an employer or union to provide additional compensation to one of its full time employees or members for undertaling the role of a trustee on a multi-employer pension fund? I can't find any prohibition on doing so. Section 408 seems to deal only with a fund paying trustees compensation.
Guest amndacatr Posted April 29, 2010 Posted April 29, 2010 You are right there is not such law, it might be because such cases are just a rare occurrence and so the right to decide remains with the employer. Though there might be some exceptions in the case regarding the feasibility of such a scheme and the place and the type of the company would also play an important role here. So, if you are still unsure about this it would be better to consult an attorney as they would be able to put some more light on this issue.
