Guest Green92 Posted March 1, 2010 Posted March 1, 2010 Does a TPA of section 125 plans have an obligation to keep enrollment forms/change in status forms or can they work completely from an electronic feed from the clients payroll company with client stating they will keep forms on file? Up until now we have collected all forms and held them on premisis and then later in secure storage.

Is the TPA also specified in the plan documents as the 'plan administrator'? (If so, does the TPA have any reason to doubt the ER will do an adequate job of keeping the election forms on file?) I have no reason to doubt the client will do their duty with respect to record retention and proper payroll set up. I'm thinking if we just tighten up the administrative serivces agreement with respect to this issue we should be ok.
