So, who else has heard late summer for the release of the EZ? This is according to the DOL. What is everyone doing? Waiting I suppose? using the 2008 form, SF (not a good option)....

Just want some thoughts.

Waiting for now. May use 2008 form if the wait goes on too long.

I thought of that but we were concerned that it may be more of a headache than it's worth. Where was it that suggested we could use that? I couldn't find the original source.

On a related question can we use a 2008 Form 5500-EZ to file a final Form 5500-EZ for 2009 if all assets have been distributed by crossing-out the "2008" year and writing in the "2009" year ?

We have been using the 2008 Form 5500-EZ to file 2009, final or otherwise. Cross out the "2008" at the top right, write in "2009", put the correct plan year dates.

Can anyone give me guidance where it was said we could do that? I know we used to but for some reason, some in my office think it's not a good idea. I just want to get started but looking for reinforcement.

It was informal guidance to ASPPA, noted in asap 10-06, and Fort William, that we know of. Nothing official.

Sungard's latest EFast2 (Part 23) bulletin is similar, though worded for plans who have short years in 2009

What filing options are available for a one-participant plan that has a filing deadline that occurs before the IRS releases the Form 5500-EZ (e.g., short 2009 plan years)?

A one-participant plan with a filing deadline that occurs before the release of the Form 5500-EZ has three options:

File a Form 5500-SF;

Use a 2008 version of the Form 5500-EZ (including the correct dates on the form) and file it directly with the IRS at its Ogden, UT Service Center. The IRS verbally informed ASPPA that a one-participant plan may use the 2008 form until it releases the 2009 version. However, as of the date of this technical update, the IRS has not formally confirmed this option. Although the IRS has not formalized this option, it is unlikely the IRS would reject such a filing.

Wait to file until the IRS releases the 2009 version of the form.

instead of EBSA in Lawrence, KS.

Hi:

Form 5500-EZ was released on Saturday.

It appears that one MUST go on the I.R.S. Website and type in the info directly from their site, then print it out and mail in. From what I have interpreted Relius and other software vendors will not be making the form available per the 5500-EZ instructions. Am I understanding this correctly?

if you go out the the IRS website you can download f5500ez.pdf

you can type in the info for the year, print and mail to the IRS. not sure if any vendor will add that to their system. there are no bar codes or anything, no electronic filing, so you are not saving any time by using a vendors software even if they add this form.

now, the form does say if the plan is a db, then complete the SB attachment

-the instructions then say while you don't file it, you 'have it on hand'
