Guest mcorson Posted May 26, 2010 Posted May 26, 2010 Last year (2008) we filed a plan with two numbers in the EIN transposed and have caught it this year. Any idea how to remedy this situation without notices being generated??
BeanCounterBlues Posted May 26, 2010 Posted May 26, 2010 Was 2008 the first year of the plan? If so it might be easier to just amend and re file 2008. Or - file 2009 w/ the "change of EIN" section filled out on the 5500. I've had situations where an incorrect ID# was used (bad info from client etc) and using the "change of EIN" section on the 5500 has solved the issue for me the couple times this has happened to me (w/o generating letters).

If there are prior filings, and you address the issue simply by changing the EIN in 2009 (& not amending 2008), the bad EIN is still out there and you are likely to receive a notice that the 2008 Form 5500 was never filed. Then, the dog starts chasing its tail in a never-ending dance with the IRS . . .
