My understanding is that the electronic filing requirements only apply to plan years beginning on or after January 1, 2009. I just wanted to verify that for a noncalendar plan year ending 9-30-09 we can still mail the paper form and schedules. The 5500 due date was 4-30-10 and a Form 5558 was filed extending to 7-15-10.

Please let me know if I have this right. Thanks!

the dol web site lists a number of Q and As, such as yours. In particular point 3 says you can still file on paper

Q2: How can I file my timely plan year 2008 annual return/report if it is due after January 1, 2010?

You have several options:

1.You can electronically file a plan year 2008 annual return/report using EFAST2-approved third-party software or IFILE beginning January 2010. EFAST2 is the new filing system.

2. You can electronically file a plan year 2008 annual return/report using EFAST-approved third-party software until June 30, 2010. EFAST is the current filing system.

3. You can file a plan year 2008 annual return/report on paper through the current EFAST filing system, using EFAST-approved software or government-issued hand print forms, until October 15, 2010.

Does that apply to the 2008 5500-EZ as well?? I have a 9/30 PYE and I am not sure if it goes to IRS or DOL. Someone at FT Williams told me IRS.

I don't have the instructions for the 2008 ez, but the 2007 says you mail the EZ to the DOL (EBSA address)

my guess is 2008 would be the same

The 2008 instructions say to mail to EBSA. However since they are not in the 5500-EZ business, I was wondering if you can still send them a 2008 5500-EZ.

So I was just confirming with 'someone' that a 2008 EZ for a one-participant DB plan with a pye 09/30/09 is filed on paper in Lawrence Kansas (EBSA)? That address is still valid until 10/15/10 for these types of filings, correct? Thanks. DN

A recent ASPPA asap stated that the mailing address for 2008 returns has changed. According to the asap, the mailing address changed from PO Box 7043 to PO Box 743. The two are so close that I wondered if that was an error.

I called the DOL Public Disclosure Room (per the asap) to ask about the address. The fellow I spoke with did not know anything about the address change but said we could mail the return to them and they would date stamp it and forward to Kansas.

Can anyone confirm that the address provided by the asap (PO Box 743) is indeed correct?

I just filed a 2008 5500 and sent it via certified mail to the EBSA address in Kansas. Today I checked to see if they received it, and it shows as being delivered to Washington D.C. Does anyone know if they are redirecting Kansas mail to DC? Thanks in advance.

Scott: That wasn't my experience. I had a client mail a 2008 5500 to Kansas for a final 7/15 due date and he received back confirmation that it was received. Nothing about redirecting to DC but again that was on 7/12 so maybe something has changed that I'm unaware of. You may want to check with Janice Wegasin of 5500help.com as she is very knowledgeable about tax form filings and she has responded personally to my emails. Donna
