Which extension is everyone checking? Automatic or nothing? At first I thoguht Automatic, but that seems to relate to piggy backing off a corporate tax extension. The 8955-SSA FAQ's indicate that the special box should not be used, except for disasters, etc.

Sungard is saying you don't mark any box if you are filing the form and using the 1/7/2012 date. The effect is to treat that as the normal due date. I have not seen a cite by them in that regard. I am simply sharing what I am hearing them say.

We just listened to a rebroad cast of their webinar titled, "The New Form 8955-SSA: Who, What, When, and How" and Derrin said it. I know not very strong level of proof. Kind of warned you about that in my first post.

I was curious where they could have gotten this from. So try this...

Here is a link to an IRS newsletter. Note it states the following:

http://www.irs.gov/pub/irs-tege/epn_2011_5.pdf (see page 3)

The due date for filing the Form 8955-SSA for both the 2009 and 2010 plan years is the later of (1) January 17, 2012

or (2) the due date that generally applies for filing the Form 8955-SSA for 2010. The IRS expects to issue guidance

confirming this extended due date shortly. The January 17, 2012 date will not be eligible for further extensions by filing

Form 5558.

It says the "due date" not extended due date or special extended due date.....

So far that is the best I can help. Maybe not what you wanted or hoped for, but it is what I know.

This form is becoming a bigger pain then it is worth.

c'mon. the form says its not due until 1/17/2012. I think that sums up everything. well, they do say

so if you don't check an extension box, what date are they going to say you were late?

10/15 of 2010 if your 2009 form 5500 was on extension?

but the SSA forms weren't even available then. From the date they were released?

But I have 60 or so that I have to submit. So you don't think you'd get relief from that?

But then software wasn't even avaialble. so again, what date exactly would you be late?

but if that is not enough, even under the Q and As it says

No. Ordinarily, the rules applicable to the extension of time for filing Form 8955-SSA are the same as those applicable to the extension of time for filing Schedule SSA (Form 5500). Thus, Form 5558, Application for Extension of Time To File Certain Employee Plan Returns, may generally be used to file for a one-time extension of time of up to 2 1/2 months after the normal due date. However, because of the special extended filing date for the 2009 and 2010 Form 8955-SSA, this automatic extension is not available for filings due on January 17, 2012. A Form 5558 may be filed, however, if the plan year (with or without extension) ends after January 17, 2012.

I've electronically filed with IRS/FIRE on July 28, and did not mark any extension box. As far as the electronic filing, the status is "Good - Released". I'll post later if we get any kind of notice from the IRS. None so far...

Am I the only one annoyed that they haven't clarified in simple plain english that you should not check an extension box? I mean I don't think I'm being foolosh for asking if I should check the "Automatic Extension" box for the AUTOMATIC EXTENSION that was granted :)

And by the way I'm not asking if I should use the special extension box, because they DID come out and say not to use that in their FAQ's.

It's just surprising that what I think is an obvious question was not answered. But it's not the first time, and I doubt it will be the last...
