austin3515 Posted September 6, 2011 Posted September 6, 2011 Let's say there are NO participants required to be reported for 2009. Does anyone have a problem with me voluntarily reporting my 2010 people in the 2009 plan year in this situaiton? I have good reasons for doing it this way, so please don't say "why don't you just report them in 2010?" Austin Powers, CPA, QPA, ERPA
pmacduff Posted September 6, 2011 Posted September 6, 2011 IMHO - I think you should be fine due to the "special" allowance that 2009 and 2010 can be combined per the instructions.
Andy the Actuary Posted September 6, 2011 Posted September 6, 2011 There does not appear to be any provision in the instructions that would prevent your action. Given the purpose of the form is to facilitate SSA's reminding the participant of a benefit entitlement, the action seems within the forms scope. The material provided and the opinions expressed in this post are for general informational purposes only and should not be used or relied upon as the basis for any action or inaction. chc93 Posted September 6, 2011 Posted September 6, 2011 FWIW... this is what I'm doing... instead of waiting for a 2010 form. Get it over with, and start "fresh" with the 2011 form.

The only reason I didn't report my 2010 terminated EEs with deferred vested benefits is the hope that they'll take a distribution and I won't have to report them next year at all.
austin3515 Posted September 6, 2011 Author Posted September 6, 2011 I just think thats one more thing to look for in the following year (i.e., next year, before D'ing them, you have to chek to see if you reported them last year). just sounds like more work in the end. But that's just my approach of course! Austin Powers, CPA, QPA, ERPA
