Guest HRAnon Posted October 13, 2011 Posted October 13, 2011 If an employer has 2 safe harbor 401k plans can the annual (safe harbor) notices be combined into one notice for both plans? The safe harbor provisions of both are the same and other provisions are similar- just different employees who are eligible for participation. All employees could potentially be eligible for either in the same plan year, or both, at different times (again within the same plan year- which is also the same for both plans.)
ETA Consulting LLC Posted October 13, 2011 Posted October 13, 2011 There's nothing to preclude it; as long as the required language is clear. Good Luck! CPC, QPA, QKA, TGPC, ERPA
GMK Posted October 14, 2011 Posted October 14, 2011 Agreed. And if it were my notice, I'd include your statements about the two plans: The safe harbor provisions of both [plans] are the same. All employees could potentially be eligible for either [plan] in the same plan year, or both, at different times (again within the same plan year- which is also the same for both plans.) as a clarification to participants.
